4 February 2022 · project and unitary operation
Alleged adverse perimeter · Acosta Matos/CAM phase
Capacity and attributed sequence
Separate mandates; visible transitions.
Sequence attributed by Gil Marer and the project's documentary classification. Every person, company, office, representation and act remains separate and must be proved source by source. It is not an adjudicated finding of conspiracy, fraud, criminal purpose, liability or guilt.
No documented event-specific capacity
The controlled sources for this family do not prove an event-specific capacity.acosta-matos-cam-stage · ACOSTA_MATOS_CAM
Identity control: Patricia Isabel Domínguez Montelongo and Laura Patricia Acosta Matos are different people; 'Patricia' is never used to merge them. Inference boundary: A Pink Canary Services role, personal participation or a later statement does not become representation of the Community, CEXP, LPB, Aweswell or another entity for this event.
Authorship and documentary control
Calling, chairing, drafting and custody are not the same function.
Rule: Attendance, representation, finance, later benefit or signature does not by itself make a person the convener, chair, author or custodian.
Historical LPH control
Five gates: call → service → vote → minutes → circulation.
CAM/project node: 20.993% recorded, CAM project, levy and LPB debt; Gil/Aweswell allege no notice and no direct communication.
The minutes record the body and chair, but the native notice, exact authority and served agenda are unlocated.
LPH arts. 13, 16 · facial concern / alleged non-complianceGil states that his perimeter received no invitation or prior knowledge; the owner-by-owner package needed to prove or refute selection, error or alternative service is missing.
LPH arts. 9.1.h, 16 · facial concern / alleged non-complianceThe minutes record 20.993%, call CAM the majority owner and charge LPB at 72.976% in the annex; title, proxies, debt, conflicts, abstentions and item-by-item votes require reconciliation.
LPH arts. 15, 17, 21 · facial concern / alleged non-complianceThree seven-page variants are controlled; the diligenced book, closure, signatures, annexes and audio remain open.
LPH arts. 19, 20 · source located; proof incompleteGil attributes later knowledge to Thompson forwarding rather than direct Community delivery; native message, hash, upstream chain, official service and later uses remain open.
LPH arts. 9.1.h, 18, 19, 21 · facial concern / alleged non-complianceHistorical text: Consolidated text after the amendment published on 6 October 2021 and in force on 4 February 2022, checked article by article. BOE →
Who called or generated the record
Community minutes recording interventions by José Daniel Acosta Matos, a CAM-supplied project and authorisations to the chair; complete notice, proxies and abstentions remain open.
Classification basis
An Acosta Matos/CAM–Community phase source. Gil attributes it to the adverse perimeter and challenges authority, voting and conflict; the minutes do not turn those allegations into findings or by themselves prove valid finance or licensing.
Boundary: Gil states that no invitation or pre-meeting knowledge reached his perimeter and that the Thompson family forwarded the ACTA only after the meeting. He reports no direct Community communication; the native message, time, upstream chain and hash comparison remain open.
Document family
Every notice, ACTA, annex, circulation, implementation and reliance keeps its own ID.
An entry does not turn an email into minutes or receipt into authority, validity or intent.

Event-by-event audit
What happened, what was communicated and what remains open.
Occurrence, authority, quorum, voting, validity, implementation, knowledge, intent, causation and legal characterisation remain separate.
| Before | No Community ACTA was located for 2019–2021 in the finite search; 2020 AEAT activity is a separate earlier track and cannot be sourced to this meeting. |
|---|---|
| Knowledge | Per Gil's current evidence, he had no invitation, pre-meeting knowledge or direct Community ACTA communication; later indirect forwarding is separately recorded. |
| Notice and service | Complete notice, agenda, recipients and service proofs are not located. |
| Omitted / excluded allegation | Gil alleges exclusion/lack of notice; the complete owner, coefficient, proxy and service denominator remains unproved. |
| Convener | The minutes record Community-organ action, José Daniel Acosta Matos interventions and a CAM-supplied project; complete legal-convener proof remains open. |
| Body | Owners' Community extraordinary meeting. |
| Attendance and representation | Attendance, proxies, voting entitlement, conflicts and abstentions remain incomplete. |
| Proposals and voting | Project, licence, unitary operation, levy, authority and debt decisions are recorded; exact wording, entitlement and title basis require verification. |
| Objections and reservations | No complete contemporaneous objection set is located; later project-side challenge and lack-of-notice account are preserved separately. |
| Minutes and versions | Seven-page control copy digitised; a second seven-page highlighted/binary variant is preserved and requires native comparison. |
| Circulation, receipt or withholding | The ACTA was transmitted in May 2022 in located correspondence; Gil's direct Community receipt remains unproved and indirect third-party forwarding requires native-header/upstream closure. |
| Implementation or non-implementation | Title, licence, levy, payments, municipal/Cabildo/tourism, financing and investor actions require source-by-source proof. |
| Later reliance | Later project/licensing actors cite or rely on the meeting; AEAT proceedings use multiple source types but began before it. |
| Contradictory evidence | Gil's attendance at 26 April 2016 is contrary/limiting evidence against a universal no-knowledge theory, but does not prove notice or knowledge of this 2022 meeting. Later receipt does not prove pre-meeting knowledge. |
| Unproved | Complete notice/service, convener authority, quorum, entitlement, conflicts, title, valid resolutions, implementation, direct receipt/withholding, causation, benefit, intent and institutional reliance remain open. |
Controlled reverse reading
What changes on 4 February 2022—and why the meeting cannot be read alone.
The meeting occurs seventeen days before deed no. 457. It does not itself prove a criminal agreement, but it creates a new debt, vote, cost, licence, unitary-operation and potential-benefit node that must be attributed actor by actor.
Aggregate present or represented; the stated unanimity is unanimity among attendees.
Total visually checked against source page 7.
€1,199,729.12 debt plus €3,260,416.81 levy; the sum proves neither validity nor double recovery.
0.770% of the budget; not a transcription from the withheld annex.
Omnidirectional bridge · 2018 → 2022 → later use
The meeting and ACTA are a conversion junction, not an isolated minute.
Gil Marer and Aweswell allege that preparation, selective exclusion, the meeting, resolutions, documentary closure, no direct communication and later use formed one enabling episode. The map displays that prosecution theory. It does not turn its arrows into proved causation or collective guilt.
- Documented
- Attributed allegation
- Inference
- Open proof
- Lawful alternative / contrary
Material control and “hotel mobbing”
Access and security, removal of guests, lost operation/cashflow, deterioration or works, frustration of the ONA exit and reduced defensive capacity are alleged as cumulative pressure from 2018.
7 June control →LPB inside; Matkator outside
LPB was in insolvency and subject to insolvency administration and judicial supervision. Matkator was not estate property. No authority over LPB alone covered its units.
Active estate and limits →Captured Community / de facto control
Debt, voting, notice, security, access, maintenance, banking and custody formed a functional apparatus. “Capture” and de facto administrator remain actor-specific legal characterisations to prove.
Audit Community–IA →Project before title
Pilots, plans, the four-sibling image, RICPE promotion and 2021 filings justify production of project and board files. They do not alone prove knowledge of the call.
Pre-title project →Prepare → call → decide → document → communicate or withhold → use
The meeting and its resolutions are documented in a located copy. Deliberate recipient selection, common purpose and every causal use remain open.
- PrepareProject, title, owners, coefficients, debt and budget.
- Design the callOrgan, agenda, first/second call and lawful-recipient list.
- Serve or omitService, returns, noticeboard, powers, conflicts and attendance.
- ResolveDebt, levy, CAM project, licences, bank and unitary operation.
- Construct the ACTARecitals, CAM majority, attendee unanimity, signatures, closure and book.
- Communicate or useDirect delivery, Thompson relay, certificates, litigation, title, works and finance.
Reading rule: each ⇄ means “bridge to prove in both directions”: fact → use/effect and result → document/custodian expected to explain it. It does not mean agreement, intent or causation has been proved.
LPH and procedural portability
Debt, loss of vote, absent-owner assent, challenge time, certification and collection depend on valid call and communication. A defective ACTA is not therefore a criminal falsehood.
LPH gates →Procedural/insolvency fraud and deed 457
The prosecution case must identify the false or omitted proposition, user, induced error or patrimonial decision, harm and benefit. The meeting preceded the deed by seventeen days; proximity is not causation.
2022 adjudication →RICPE/RIC · regional incentive · FEDER
Amounts are not added. Cross-match property, work, invoice, job, title/authority statement, other support, payment, certification and beneficiary to detect reuse or incompatibility.
Funds traceability →CAM → HNT → MYND
Segregation, works, operation and revenue permit value and benefit tracing. They do not automatically transfer intent, corporate crime or successor guilt.
Financial lives →“Hotel mobbing”
This is Gil/Aweswell’s attributed umbrella label for sustained pressure on access, guests, operation, assets, evidence, funded exit and defence. It is not a standalone offence: each episode must, if appropriate, satisfy coercion, usurpation, damage, frustration, falsity, disloyal administration or another offence separately.
Were the assets “court-protected”?
The accurate phrase is: LPB assets formally subject to insolvency-administration and judicial-supervision safeguards, whose practical effectiveness is disputed. That is a protection architecture, not a guarantee of outcome. Matkator remained outside it.
De facto administrator does not mean influence
The record supports inquiry into de facto control of discrete functions. Legal status in relation to LPB requires stable autonomous management or habitual decisive influence, instructions followed, continuity, knowledge, benefit and the date-specific standard.
Lawful reading that must be preserved
The minutes distinguish common works said to be “strictly necessary” to operate in the existing one-star category—allocated among owners—from the additional four-star upgrade, which CAM offers to undertake at its own cost. If the debt, notice, votes and technical classification are valid, CAM’s parallel benefit does not turn a common charge into a crime.
Adverse hypothesis that must be proved
If those already preparing the conversion knowingly classified enabling capex as common expense, used materially invalid debt or voting, and shifted cost to LPB and Matkator after depriving them of use and income, the resolution could be an additional patrimonial act. The ACTA calls CAM the majority owner while the annex still charges LPB at 72.976%; both title alternatives must be reconciled. Notice, proxies, coefficients, votes, abstentions, certificates, accounts, project, measurements, invoices, implementation, flows and intent are required.
Not arithmetic
Community, RICPE/RIC, regional incentive, FEDER and operation are separate legal tracks. The test is whether properties, works, invoices, jobs, authority or value were reused, what was disclosed at each gate, and who knew or used a possible falsehood—not the addition of heterogeneous amounts.
LPH and alleged non-knowledge
Gil Marer states that his perimeter received no invitation or pre-meeting knowledge and no direct Community ACTA communication; the Thompson family forwarded the ACTA only after the meeting. Gil and Aweswell allege a unitary sequence of call design, selective service or omission, meeting/resolutions, no direct communication, third-party discovery and later use. It is not proved. The repository contains this ACTA copy, not the native invitation and owner-by-owner service package. LPH Articles 9, 15–19 and 21 require reconstruction of recipient, address, service, first/second call, debt/vote, majority, direct ACTA delivery, actual knowledge, dissent and challenge. Official historical text →
Corrected knowledge route
The allegation is not that the ACTA was never obtained. Gil says it arrived after the meeting through Thompson. The native message, exact time, upstream transmission and hash comparison can prove when and which version reached his perimeter and provide a distribution comparator; they do not alone prove intent.
Alleged pattern from 2016
Gil alleges concealment of certain other meetings or attempts from at least 2016. It must be reconstructed meeting by meeting. The 26-April-2016 meeting was known and attended, preventing any claim that every meeting was concealed.
What the ACTA does prove
It proves the recorded decision instrument, resolutions, 20.993% and timing. It does not itself prove who was called, whether an LPB/Matkator proxy appears in the redacted section, who controlled service, or criminal intent.
Package capable of proving intent
Known correct recipients/addresses + list versions + messages/instructions + unequal service or conscious omission + false recital or selective direct communication + authenticated Thompson/upstream chain + rapid downstream use + reasoned exclusion of error, delegation or insolvency confusion. Each bridge must attribute act, knowledge, purpose and effect to a person.
| Actor / entity | Visible or controlled 2022 fact | Proof still required for responsibility |
|---|---|---|
| Francisco Mario Matos Matas secretary-administrator / Pamalexsha lane | The administrator explains the debt; the controlled chronology also places him in administration and the bank-authority lane. | Appointment, custody, calculation, certificates, bank, instructions, knowledge and benefit. |
| José Daniel Acosta Matos chair / project | He explains the only project presented, supplied by CAM; the controlled record identifies him in the chair. | Title and power at date, conflict, vote/abstention, engagement, fees, finance and benefit. |
| Laura Patricia Acosta Matos CAM representation | The public page shows her as legal representative of Construcciones Acosta Matos, S.A. | Power, property/coefficient, vote, instructions, title knowledge and purpose. |
| Javier Acosta Matos^ witness/document-first | The public page shows him representing Construcciones Acos-Matos, S.L.^; BORME identifies him as a CAM director in 2020 and Canarian Hospitality director in 2021. | Power, properties/coefficient, actual vote by item, meeting/ACTA/project knowledge, conflict, records and benefit. Offices and attendance do not prove participation. |
| Gerardo Zacarías Acosta Matos^ image/document-custody first | Gil identifies him as the bearded sibling at the far right of the published image; corporate records place him in the perimeter. This ACTA does not record him as an attendee. | Original/metadata, connection of plans to Sun Park, board packs, prior knowledge, communications, custody, implementation, conflict and benefit. The image alone does not prove participation. |
| LPB / Matkator distinct legal persons | LPB was inside Insolvency Proceeding 36/2012; Matkator was outside it. LPB insolvency authority cannot be extended to Matkator. | Individual notice and representation, balances, coefficients, use, fruits, challenges and levy implementation. |
Use boundary: the source is a located seven-page copy, not the diligenced minutes book or a certified copy; the OCR is not line-by-line certified. Gil attributes the route to post-meeting Thompson forwarding, but the controlled binary is not yet identified as the native forwarded attachment without the message and hash comparison. Nominal pages 5–6 remain publicly redacted. “Laura”, “José” and “Javier” are transcribed as the public page records them; controlled full names are used only where identity is closed by the repository.
Public redacted source text
Page-sequenced OCR with visible redactions.
This is not an expert transcription or line-by-line certification. Markers preserve withheld or illegible material; an OCR spelling incompatible with a controlled legal entity is normalised and marked.
