SUN PARK
En Playa Blanca, siendo las 12,00 horas del dia 2 de febrero de 2011, y en los
salones del Complejo, debidamente convocados, se retinen en segunda convocatoria
para tratar los siguientes puntos del orden del dia previstos en la convocatoria.
ORDEN DEL DIA
01.-Demanda contra la Comunidad interpuesta por diversos comuneros
solicitando anular los acuerdos adoptados en fecha 25/05/09. Medidas a
adoptar.
02.- Presentacién y aprobacién, si procede, de las cuentas de ingresos y
gastos correspondientes al ejercicio 2009.
03.- Presentacién y aprobacién, si procede, de las cuentas de ingresos y
gastos correspondientes al ejercicio 2010.
04.- Presupuesto de ingresos y gastos para el ejercicio 2011
05.- Dimisién de los actuales cargos directivos y administrativos.
Nombramiento de nuevos cargos.

Una vez confeccionada la lista de asistentes y ante la ausencia del Presidente y del

para explicar que con cardcter previo al inicio de la Junta se debe proceder a nombrar
Presidente y Secretario de la reunién y pregunta quienes quieren serlo ante lo cual se

don [NOMBRE DE PERSONA REDACTADO] como Secretario, nombramientos que sometidos a
votacién son aprobados por unanimidad de los presentes.
Abierta la sesién por la [NOMBRE/REFERENCIA PERSONAL REDACTADA], se pasé a tratar los diferentes puntos del
Orden del Dia.
01.- Demanda contra la Comunidad interpuesta por diversos comuneros
solicitando anular los acuerdos adoptados en fecha 25/05/09. Medidas a adoptar.
El [NOMBRE/REFERENCIA PERSONAL REDACTADA] el contenido de la demanda
presentada por los propietarios que él representa contra los acuerdos de la Junta de
Propietarios de fecha 25/05/2009 que pudieron ser aprobados por la propietaria Luchy
Playa Blanca, S.L. porque se privé del derecho de voto a los propietarios que él
representa a excepcidn de la entidad Roque Prieto. [NOMBRE/REFERENCIA PERSONAL REDACTADA] [NOMBRE DE PERSONA REDACTADO] explica que
entre otros acuerdos se acordé incrementar la cuota de la comunidad de 88 euros a 170
euros. El Sr. [NOMBRE DE PERSONA REDACTADO] propone que se someta a votacién si la Comunidad de
Propietarios se allana a la demanda presentada contra los acuerdos de fecha 25/05/09.
Se somete a votacién y se APRUEBA la propuesta de allanarse a la demanda,
por 45 votos a favor y 3 en contra de los propietarios representados por don [NOMBRE DE PERSONA REDACTADO]
y dofia [NOMBRE DE PERSONA REDACTADO].
02.-Presentacién y aprobacién, si procede, de las cuentas de ingresos y gastos
correspondientes al ejercicio 2009.
La [NOMBRE/REFERENCIA PERSONAL REDACTADA]s cuentas o si alguien las ha
recibido, contestando la Sra. [NOMBRE DE PERSONA REDACTADO] que las tiene e] Administrador que
no ha venido. Se decide por unanimidad no tratar este punto porque no se disponen de
las cuentas en este acto y no se pueden someter a votacién.
03.- Presentacién y aprobacién, si procede, de las cuentas de ingresos y gastos
correspondientes al ejercicio 2010.

las tiene o las ha recibido y nuevamente se decide por unanimidad no tratar este punto

05.- Dimisién de los actuales cargos directivos y administrativos. Nombramiento
de nuevos cargos.
Se presentan los candidatos que a continuacién se mencionan y se somete a
votacién con el siguiente resultado:
- Presidenta de la Comunidad: Dofia [NOMBRE DE PERSONA REDACTADO]. en
representacion de la entidad Roque Prieto, S.L. (propietaria del [FINCA REDACTADA]).
Se aprueba su nombramiento con 45 votos a favor y 3 en contra de los
propietarios representados por don [NOMBRE DE PERSONA REDACTADO] y dofia [NOMBRE DE PERSONA REDACTADO].
~ Secretaria de la Comunidad: Dofia [NOMBRE DE PERSONA REDACTADO], propietaria del [FINCA REDACTADA]. Se somete a votacién y su nombramiento es aprobado por unanimidad.
- Tesorera de la Comunidad: Dofia [NOMBRE DE PERSONA REDACTADO], propictaria del
[FINCA REDACTADA]. Se somete a votacién y su nombramiento es aprobado por
unanimidad.
A continuacién se somete a votacién Autorizar el cambio de la representacién y firmas
autorizadas de la cta. cte. de la Comunidad de Propietarios en CajaCanarias, con
capacidad de disposicién mediante firma mancomunada de la Presidenta [NOMBRE/REFERENCIA PERSONAL REDACTADA]
[NOMBRE DE PERSONA REDACTADO] y de la Tesorera [NOMBRE/REFERENCIA PERSONAL REDACTADA] [NOMBRE DE PERSONA REDACTADO],
resultando dicha propuesta aprobada con 32 votos a favor, trece abstenciones y tres
yotos en contra.
Asimismo se somete a votacién autorizar a la Presidenta para que contrate los servicios
de un Administrador y se aprueba por unanimidad.
06.- Deuda contrafda con el Plan Parcial Papagayo. Medidas a adoptar.
Al no contar en este acto con la documentaci6n ni con la informacion a la que se
refiere este punto del orden del dia, se autoriza por unanimidad a la Presidenta de la
Junta por unanimidad para recabar informacién sobre este asunto. El Director de la
Explotacién del Complejo, [NOMBRE/REFERENCIA PERSONAL REDACTADA], en representacion de [NOMBRE DE PERSONA REDACTADO],
nos indica que el puede darnos algunos datos, pero que no los tiene en ese momento.
07.- Demanda presentada por el Administrador contra la Comunidad.
Medidas a adoptar.
Tampoco se dispone del escrito de demanda presentada por el anterior y por esta
raz6n se autoriza por unanimidad a la Presidenta de la Junta para que proceda a recabar
la informacion necesaria para poder someter a votacién y adoptar un acuerdo sobre este
asunto. Asimismo el [NOMBRE/REFERENCIA PERSONAL REDACTADA], indica que puede darnos informacién sobre la demanda,
pero que no la tiene en ese momento.
En cualquier caso se acuerda por unanimidad autorizar a la Presidenta para que
pueda otorgar en representacién de la Comunidad de Propietarios poder general para
pleitos a favor de los procuradores de los tribunales que estime oportunos.

08.- Problematica Licencia Turistica
Toma la palabra Don [NOMBRE DE PERSONA REDACTADO], informando que la licencia de la anterior
explotadora Montelanza ha caducado y deben realizar la renovacién. Al parecer se
precisa disponer de la Unidad de Explotacién de todo el Complejo para poder conservar
la categoria de Hotel. Se debate ampliamente sobre este tema, ya que existen
propietarios que tienen la posesién de los apartamentos y no quieren entregarlos a la
explotacién y también existen propietarios cuyos apartamentos estén siendo explotados
sin su consentimiento ni autorizacién por la Comunidad de Explotacion y que quieren
recuperar la posesién de sus apartamentos.
Se desestima la adopcién de ningtin acuerdo sobre este asunto por considerarse
que no es un asunto que deba tratarse en la Junta de la Comunidad de Propietarios.
09.- Cierre o continuidad explotacién complejo. Cierre por vacaciones mayo y
junio 2011.
No se entra a debatir sobre este punto del orden del dia por considerarse que es
un asunto ajeno a la Comunidad de Propietarios.
La segunda parte del punto, nos damos por enterados.
10.- Ruegos y Preguntas.
Por parte de algunos nuevos propietarios se ruega a la [NOMBRE/REFERENCIA PERSONAL REDACTADA], la
aclaracién en algunos errores en los nimeros de apartamentos.
Y sin mas asuntos que tratar, la [NOMBRE/REFERENCIA PERSONAL REDACTADA] las
