No public document copy is linked from this record. This does not mean that the original does not exist: recovery, custody and public release are verified separately.

Partial coverage: the complete docket and every annex are not certified. A pleading copy does not by itself prove filing; a party report or prosecutorial opinion is not a judicial decision.

9 SEPTEMBER 2026 · CURRENT CONTROL

9 September filing verified; court processing remains open

The corrected 9 September filing was presented in DP 748/2026. It asks the court to process the subsidiary appeal already interposed with the 17 April reforma, supplies Article 766.4 allegations ad cautelam, and places the 3 September Cuatrecasas ETJ opposition before the criminal track as supervening evidence. What remains unverified is the court's subsequent treatment: formal Article 766.4 processing, transfer to other parties, remittal to the Audiencia Provincial, assigned appellate roll and outcome.

MASTER PROCEEDING · TF-CRI-003

DP 748/2026

The criminal-investigation theory is not limited to the physical identity of finca 8.584. The finite question is whether any source-proved part of the wider billing → debtor-attribution → instrument → judicial-title → enforcement → recovery chain was materially false, incomplete, duplicative or knowingly used to obtain a prejudicial judicial disposition.

Whole-claim criminal scope

Finca 8.584 is an exact downstream asset, not the boundary of the alleged conduct. The controlled upstream record contains Aweswell/LPB invoices, WIP/unbilled work, pro-formas, four Matkator pagarés, two judicial claim principals and a later grouped balance. DP 748 can only lawfully test criminal significance through concrete acts and evidence; the factual universe should not be artificially reduced to the physical/Registry status of one finca.

Finite investigation matrix

ElementWhat must be proved/tested
1 · Mandate/workWho engaged Cuatrecasas for each matter; what work was actually performed; which entity benefited or was liable.
2 · Billing/WIPAccuracy of issued invoices, time narratives, WIP, pro-formas, VAT, credit notes and conversion of unbilled work into later claims.
3 · Debtor attributionWhy work/invoices principally documented to Aweswell/LPB were later represented through four Matkator pagarés and a Matkator judicial debt.
4 · Instrument cause/authorityOriginal notes, signing capacity, assumption/guarantee/accommodation, consideration/cause and exact value allocation.
5 · Court representationWhich specific Cambiario/ETJ statement or omission is alleged inaccurate/incomplete and whether it was legally material.
6 · Judicial error/dispositionWhether any materially false/incomplete representation was capable of inducing a decision different from one made on the full facts.
7 · Claim overlap/satisfactionWhether Claim 1, Claim 2, WIP and all payments/credits/realization values reconcile exactly once.
8 · Transfer/beneficiaryAny actual assignment, adjudication, cession, consideration, recipient, beneficial owner and source-of-funds trail.

Source correction: direct collection did occur

The repository does not use “Cuatrecasas never demanded Aweswell” as a proposition. June-2020 emails show direct Aweswell collection/settlement dialogue, and LPB invoices were chased. The potentially material issue is the later legal/economic migration from Aweswell/LPB client-billing context to Matkator instrument/judicial-debtor status, and whether the original documents provide a lawful, accurate bridge.

Concurso correction

Cuatrecasas was active counsel in Concurso 36/2012 and withdrew in May 2020 citing unpaid fees. The current controlled search has not located proof that it lodged/proved its own fee credit as creditor in that insolvency. That absence is a retrieval gap, not proof no filing existed. If located, the insolvency-credit treatment must be reconciled against the two later judicial claims and any single-satisfaction accounting.

3 September ETJ opposition remains double-edged

Affirmative evidentiary value

It fixes Cuatrecasas's current position, exact asset 8.584, knowledge of the physical controversy, persistence in seeking adjudication and express request for faculty to cede remate.

Counter-value

It openly discloses the physical/registered-identity controversy and offers a Registry-law explanation. It therefore does not by itself prove concealment, deception, judicial error or criminal intent in the later phase.

Acosta Matos / onward-benefit hypothesis

Gil Marer advances the hypothesis that the broader claim structure could create transferable economic leverage over Aweswell through Matkator and that an eventual recipient might connect to the Acosta Matos perimeter. That proposition is preserved for investigation but not adopted as fact or as the only possible destination.

Required proof includes assignment/cession/adjudication instruments, consideration, communications, KYC/beneficial ownership, source of funds, accounting and a concrete link to CAM/HNT or another perimeter entity. A request to cede remate is not proof of a connected recipient.

Non-conflation: Cambiario 1048/2019, ETJ 163/2020, DP 748/2026 and Concurso 36/2012 are distinct proceedings. Cross-links show evidence, chronology, accounting or investigative relevance; they do not establish joinder, common intent, professional misconduct, criminality or liability.
