Open Cambiario →LA LAGUNA CONTROL · 9 SEPTEMBER 2026
Cambiario 1048/2019 → ETJ 163/2020 → DP 748/2026, placed inside the wider invoice/WIP/pagaré/two-claim architecture.
TF-CIV-001One title-forming route. Four Matkator pagarés and €182,517.72 principal. It must be reconciled to the wider Aweswell/LPB billing and WIP universe rather than treated as the whole fee claim.
Open Cambiario →TF-CIV-002Enforcement against Matkator. Finca 8.584 is the exact located realization target; the 3 September opposition asks for adjudication and ability to cede the remate.
Open ETJ →TF-CRI-003Separate criminal track. The 9 September filing is verified as presented. It asks to process the existing subsidiary appeal, uses the 3 September ETJ opposition as supervening evidence and preserves a finite investigation route. Court treatment after filing remains unverified.
Open DP 748 →The filing does not ask the criminal court to decide the entire civil billing dispute. It seeks an act-specific investigation into the formation/use of the title and the current enforcement position, while preserving debtor/cause, service, property correspondence and beneficiary questions for documentary verification. The wider whole-claim architecture on this site supplies context and investigative hypotheses; it is not presented as if every repository proposition were already pleaded or proved in DP 748.
The repository no longer uses the categorical proposition that Cuatrecasas “never demanded Aweswell”: current emails show direct collection/settlement dialogue. It also does not say Cuatrecasas “never went to the concurso”: Cuatrecasas was active counsel in Concurso 36/2012 and withdrew in May 2020 citing unpaid fees. What remains unverified is whether Cuatrecasas lodged/proved its own fee credit as creditor in that insolvency, whether a separate judicial fee action against Aweswell existed, and whether a distinct hotel-level demand was served.
The 3 September ETJ opposition verifies a request for adjudication of 8.584 and faculty to cede the remate to a third party. It does not prove a completed cession, transfer of the whole credit or any Acosta Matos/HNT recipient. Gil Marer's hypothesis that a broader transferable claim structure could ultimately benefit the Acosta Matos perimeter is preserved as an investigative hypothesis only and is gated to assignment/cession, consideration, communications, KYC/beneficial ownership, source-of-funds and accounting evidence.
Billing discrepancies, a fee claim, an autonomous pagaré, enforcement, a remate-cession request and a contextual link to the hotel perimeter are not criminal by themselves. The repository separates verified source facts, adversarial positions, Project Sun Rock allegations, inferences and gaps. No Acosta Matos participation or beneficiary status is inferred without direct evidence.
