Gil Marer and Aweswell Limited seek a positive chain of recovery: establish the banking loss, reconcile what Luchy Playa Blanca, S.L.U. (LPB) owed and paid, recover value for the proper beneficiary, and use the resulting evidence and resources to pursue restoration of assets, the hotel business and other proven losses. This is an express recovery objective. Each step has its own claimant, evidence, remedy and legal conditions.
Who brings the claim, and for whose benefit? The located 27-page claim copy invokes Article 122 TRLC: Aweswell claims standing as LPB's creditor to pursue a patrimonial action at its own expense in the interest of LPB's insolvency estate. CaixaBank disputes that standing and its scope. An estate recovery must therefore be traced through LPB's accounts and the applicable insolvency treatment; it is not automatically a direct payment to Aweswell or a transfer of the entire hotel. Article 122 separately regulates reimbursement of the pursuing creditor's litigation expenses following a favourable final judgment, limited by what the estate actually receives. BOE · Article 122.
Amount and requested relief. Paragraph 30 estimates €1,124,445.84 plus interest and costs; paragraph 71 describes that amount as provisional for determining the appropriate procedure. The prayer seeks nullity of the swap and the linked first-loan amendment, €405,000 pledge and €850,000 second loan, with restitution, or subsidiary damages. The admitted pleadings, expert evidence and any subsequent clarification must determine the operative scope. The figure is neither an adjudicated recovery nor proof that all wider hotel losses are included; a provisional amount does not create an unrestricted right to quantify later. BOE · LEC Articles 218–219.

A concrete earlier connection. The located Auto of 24 February 2021 in Concurso 36/2012 expressly refers to anticipated delay in annulment actions to be brought against Bankia when extending liquidation for one year. Its party table describes Aweswell as a creditor. This is an earlier court-record reference to the contemplated bank action; it does not decide bank liability, finally determine the standing now contested in Valencia, or establish what the Fiscal knew in 2019.
Settlement and restoration. A settlement may provide agreed payment or other lawful performance, but its authority, beneficiaries, scope and implementation must be explicit. A civil settlement does not itself extinguish the public criminal action. A money recovery does not itself reverse later titles. Registration does not cure a null transaction; protection of qualifying third parties and the procedure for rectification must also be assessed. BOE · Civil Code Articles 1813, 1815–1816; Mortgage Law Articles 33–34; Article 40.
Contested issues remain visible. CaixaBank's defence raises creditor standing, the prior request and its scope, the nature of the action, funding conditions, prior insolvency credit recognition, time bars, information and consent, causation and quantum. These are the defendant's positions, not findings adopted here. The project seeks additional lawyers to assist the existing legal team with evidence review and negotiation with CaixaBank.
