SOURCE · CONTRADICTION · DECISION · GAP
A source-controlled reconstruction of opening, plan approval, opposition to reported operations, inspection and extension in Insolvency 36/2012. It separates what the court decided from party positions, expert opinion and missing material.
Official sequence
The chronology does not convert authorisation into implementation or a procedural rejection into a finding that an alleged event did not occur. Each card states effect and limit.
Opened LPB's liquidation, suspended its powers over its own property, required a plan within fifteen days and quarterly reports.
Not decided: that all of Sun Park belonged to LPB.
Approved the proposed dation route for mortgaged properties and a separate EUR 400,000 premises/pools line, with publication and a better-offer window.
Not decided: that any valuation was proved or that later implementation met every condition.
Confirmed the 24-Oct-2019 order and applied res judicata to the 23-Jul-2019 AP interest framework.
Limit: demolition, expert, inspection and access requests were treated as new/out of time in that motion; their truth and responsibility were not decided.
Partially allowed reconsideration only to replace the reasoning; maintained denial of filing 7,299. The court could not identify ownership of photographed interiors.
Adverse, limited reasoning: it regarded common-area rubble as causing no damage beyond a removable aesthetic effect, did not attribute the start of common-area works to CAM, and found the sale delay not attributable to the court or AC.
Not established: absence of damage throughout the estate, a complete property map or the result of a later responsibility claim.
Granted one further year. It cited known difficulties and expected delay from nullity actions to be brought against Bankia.
Not decided: Bankia liability, the object/success of any action, or any matter called “No-Swap”.
Balanced reading
This matrix prevents one side's filing from being presented as conclusive proof.
| Node | Aweswell / LPB position | AC / CAM position | Court observation or holding | Open source |
|---|---|---|---|---|
| Separate sale / EUR 400,000 | The 16-Jan-2019 filing alleged breach of the suspended plan, ob-rem severance and favour to CAM. | The fourth report, as quoted, described a 28-Nov-2018 deed and EUR 400,000 receipt. | The 16-Apr order had authorised that line subject to conditions; the later non-validation record must establish what implementation was valid. | Fourth report, deed 2,150, 12-Dec act, 24-Oct-2019 order, Registry and accounts. |
| Works / condition | Alleged demolition, rubble, deterioration and need for inspection/expert evidence. | CAM said it owned 54 units and had carried out works in some of its own units, as well as Community measures; AC denied handing over possession and cited certificates. | The 24-Feb order could not identify ownership of interiors; treated common-area rubble as a removable aesthetic effect, did not attribute the start of common-area works to CAM, rejected delay attributable to the court/AC and maintained the denial. It did not make a global finding about the whole estate. | Original photos/EXIF, titles, licence, certificates, reports and property-photo overlay. |
| Expert access | The email print purports to record a request for experts to be authorised. | The visible response attributed to AC proposes a videoconference. | No native source, order or outcome here proves authenticity, authorisation, refusal or a completed inspection. | RFC822, attachment, later replies, access record and expert/notarial output. |
| Extension | LPB and Aweswell are recorded as consenting. | AC requested more time. | The court granted one year; reference to Bankia actions is reasoning, not a nullity judgment. | Application, responses, finality, later extensions, Bankia action and closure. |
