Media Hall of Shame · source-led accountability

BBC

Editorial authority.
Unresolved accountability.

A record of the pre-broadcast warnings, New Horizons source contacts and the BBC's subsequent responses concerning Sun Park Living.

An editorial assessment by Gil Marer / Por Derecho. “Media Hall of Shame” is this project's critical designation, not a court or regulator's finding. The BBC's position, contrary evidence and the limits of this review appear alongside the criticism.
GIL MARER'S ATTRIBUTED ASSESSMENT

“Institutionally defensive, procedurally dismissive, and insufficiently transparent about its substantive consideration of the evidence.”

The criticism is not that the BBC listened to customers. It is that a specific challenge to the provenance, reliability and context of its source material was raised before broadcast, yet the replies reviewed do not explain how that challenge was tested.

What the record establishes—and what it does not

A documented pre-broadcast challenge

The 3 January 2019 notice identified New Horizons, programme-related contacts, disputed customer statements and alleged harm to the operating company, shareholders and sales-and-marketing partners. Page two contained screenshots, including a captured BBC self-identification. The BBC acknowledged the letter on 8 January and confirmed its intention to proceed.

No finding of conspiracy or liability

Source contact is not proof of improper coordination. Receipt of an allegation is not acceptance of its truth. This review has not independently reconstructed the complete transmitted item or the BBC's internal editorial file, and does not establish that no internal review took place.

The BBC's stated inclusion of Sun Park's explanation and its invitations to respond are material contrary facts, not footnotes.

The source-contact evidence

One reviewed image facsimile appears below alongside identified transcriptions and descriptions of other preserved captures. No Facebook screenshot has been recreated. The displayed image is a cropped, monochrome derivative of the actual capture embedded on page two of the pre-broadcast notice, with contact details masked.

5 October 2018: a member relays a programme-specific invitation request

The captured post attributed to Janice Turner describes Ian Griffiths as a producer of Rip Off Britain, says she and others had spoken with him, and reports that he asked her to seek an invitation to the group. Its visible date tooltip reads 5 October 2018, 13:20.

“My name's Ian Griffiths and I work for the BBC on the Rip Off Britain television programme.”

The displayed post thanks the group for inviting him, acknowledges debate over membership, and invites contact through a BBC email address or Facebook. It also says he does not wish to contact people who do not want contact. That qualification is preserved.

December 2018 / January 2019: programme scheduling correspondence shared in the group

A preserved capture displays Christine sharing a scheduling exchange attributed to herself and Ian Griffiths. Her displayed message says she established New Horizons. The reply discusses scheduling and sharing the information. The original message displays 31 December 2018 and the reply display reads Wednesday 2 January; the filename's 1 January label is not treated as authoritative.

The separately preserved 8 October admission discussion includes objections to admitting journalists and a statement that each person could choose whether to participate. Membership is not proof of a shared purpose or culpability.

Notice, response and closure

The BBC replied to the UK solicitors' 12 December letter, explained its production timetable, extended the response deadline to 17 December and promised notice of transmission. The preserved attached email includes the BBC-to-solicitor routing headers. This was engagement, not silence.

PD-BBC-E07

The operating side sent a detailed notice to BBC legal and production contacts, identifying the source-network concerns and including the screenshots. Its allegations remain allegations. Statements in the notice about consumer rights, privacy or remedies are not adopted here as legal findings.

PD-BBC-E02

The BBC acknowledged the notice, cited customers' disappointment and confusion, and said it would proceed. It invited a further response and said it would otherwise reflect the position from the letter. Its reply did not explain how the specific source-provenance challenge had been examined.

PD-BBC-E03

The BBC confirmed transmission for 22 January 2019 at 09:15 on BBC One. On 21 January it acknowledged receipt of a further legal communication. Some later complaint subject lines say 11 January; the contemporary transmission notice controls the date used here.

PD-BBC-E04

The series producer stated that the programme complied with BBC Editorial Guidelines and that Sun Park's third-party-illegal-activities explanation had been reflected. She said there were no plans to revisit the story and directed further programme correspondence to her.

PD-BBC-E05-A

The producer acknowledged the further request and said she would discuss it internally and respond. This prevents an assertion that the request was never acknowledged or that no internal discussion could have occurred.

PD-BBC-E05-B

The replies invoked the programme's age, viewing unavailability and the editorial-complaint time limit. The final reply referred to the complaints framework, identified the legal department as an alternative and closed further correspondence with that programme contact. It did not establish that every BBC avenue was closed.

The BBC's position belongs in the record

The BBC says it reflected Sun Park's explanation that activities for members and guests had ceased because of illegal activities against the hotel by third parties. It asserts editorial compliance. It invited responses before broadcast, extended a December deadline and offered a further January opportunity.

The criticism is not total suppression of Sun Park's response. It concerns whether the evidence and its implications were adequately investigated and reflected in the programme's overall meaning. Including an explanation is not, by itself, a demonstrated examination of its factual basis.

Disappointed customers could have legitimate concerns even where wrongdoing against the business was also alleged. Neither account automatically resolves the other. The full broadcast, source records and editorial assessment are needed to test the competing explanations.

Sun Park Living was not merely a hotel building

Gil Marer's position concerns the wider holding-company-led travel, leisure and community platform: its identity, goodwill, customer trust, commercial relationships, information and capacity to continue or recover. The hotel business was a component, not the full definition of the alleged injury.

The contemporary notice itself referred to shareholders and marketing partners; its Schedule A distinguished the community experience and activities from accommodation provision. That records the position communicated, not proof of ownership of every asserted right or quantification of loss.

Each rights-holder, publication, audience and causal contribution must be identified separately. BBC editorial decisions, Camel travel selling, consortium relationships and Acosta Matos-related conduct are connected questions—not interchangeable legal capacities.

Four questions requiring a substantive account

Source verification

What steps tested the origins, reliability and context of material obtained through the customer network?

Pre-broadcast notice

Who assessed the 3 January evidence and what conclusions were reached before transmission?

Subsequent review

What substantive consideration followed the February 2025 undertaking to discuss the request internally?

Correction and context

What would warrant correction or clarification, and how were the wider platform and alleged third-party conduct distinguished?

These are accountability questions. They do not assert an unrestricted public entitlement to confidential editorial files or establish that a procedural deadline was unlawful.

Correction, reply and connected reading

The BBC and every person mentioned retain a full opportunity to respond and correct the primary record. Any substantive response should be attributed and integrated with comparable prominence. Por Derecho does not ask the BBC to accept its account uncritically; it asks for the challenged account to withstand scrutiny.

Editorial independence should protect the freedom to investigate—not insulate the resulting account from scrutiny.
