UNITARY MATRIX · SOURCE → KNOWLEDGE → POWER → ACT/OMISSION → CONSEQUENCE
The opposing record supplies much of the map. The institutional gates determine what it became.
This is not a guilt-by-association page. It identifies propositions generated by CAM, Community, ACTÚA, the Insolvency Administrator and judicial records themselves, then asks what the Administrator and judge knew, could lawfully do, did or did not do before the next difficult-to-reverse step.
The private/institutional record does not support a single-owner, single-condition story
Administrator and judge: different gates, same timeline
| Stage | Administrator | Judge / Court | Unresolved causal question |
|---|---|---|---|
| CAM creditor recognition | Favourable report; verification premise. | 8-Feb-2018 holder substitution relies on AC verification. | What assignment economics, schedules and validity checks were actually verified? |
| ACTÚA / Plan | Authors Plan; adopts/recommends ACTÚA/CAM route. | 16-Apr Plan approval; separate interest-cap ruling. | What ACTÚA/GESVALT material was actually before each gate, and how was it reconciled? |
| Security/access | Requests Community security resolution on LPB's behalf; later access authority is part of the record. | No primary CAM possession/eviction/whole-hotel control order identified. | Did limited preservation authority become materially broader control over a mixed-title operating hotel? |
| 7 June / ONA | Scope, monitoring, preservation and response are to be reconstructed. | 26-Jun stay protects listed realisation; what effective protection addressed operation/access/value? | Did control impair the live operator/finance counterfactual, and who caused each failed condition? |
| 31-finca deed | Executes Protocol 2150 before later LAJ formalisation; later seeks convalidation. | 24-Oct-2019 refuses convalidation. | Was the patrimonial position actually restored—cash, title, competition and Registry—or merely procedurally corrected? |
| 2020–21 works/access | Conservation treated as AC function; says no LPB possession delivered to CAM. | Neutral inspection/stop-work relief remains refused on the record. | What reliable neutral equivalent established condition, asset identity and deliverability before competition? |
| 2021 competition | Supports CAM route / supplies conditions. | 18-May definitively approves CAM after Ottawa nonappearance/nondeposit. | Complete bidder file, hearing, funds, notice and comparative reasoning. |
| 2022 implementation | Executes Protocol 457 and undertakes five-day court report. | Prior approval/confirmation/clarification supplies judicial predicate. | Final debt, five-day receipt, cancellations, €400k branch, surplus, Registry and accounts. |
The unit-condition issue: a self-created-distress hypothesis to prove or disprove
The 22-Jun-2011 map has 29 of 40 apartment references in the 400/500 ranges. A contemporaneous 17-Apr-2018 party communication alleged two closed minority-owner blocks / 61 apartments and extrapolation by ACTÚA. GESVALT's 1-Mar professional critique said approximately 44 units were in poor condition and the remainder usable. Corrected Blocks 4+5 contain exactly 44 apartments.
Falsification test: ACTÚA photograph → apartment → finca → corrected block → contemporaneous owner/controller → access provider → operating/maintenance condition → source supplied to ACTÚA.
Anti-fragmentation test for a fresh court or prosecutor
The safer proposition is not that the court was simply “uninitiated” or unaware. Different pieces entered the record at different times: fragmented title, ACTÚA, contrary valuation evidence, access/security disputes, mixed ownership, works/inspection disputes, ONA/finance, a real competing bidder and later ownership publicity. The question is when the connected record became sufficiently developed that continued atomised treatment of value, title, access, operation, finance and competition requires its own documented explanation.
