DO NOW · appeal → record → evidence → corrective jurisdiction

Las Palmas Provincial Court, Section 4: what is actually before the chamber, and what can it correct?

This page does not seek to pressure individual judges. Its purpose is to show which appeals exist, what record reached second instance, what later evidence has been sought, and which procedural questions condition appellate review.

Three material procedural tracks

RPL 2523/2025

A 16 September 2025 LexNET filing to Section 4 requested information and certifications from the culpability section: appearing parties, creditor submissions, recipients of the culpability report, and reasoned/documented creditor reports. The value of this track is record completeness in the culpability appeal.

RPL 3304/2025

An order signed on 8 June 2026 set deliberation, vote and judgment for 9 July 2026. That document is a scheduling act, not a merits decision.

RPL 3304/2025 + 3319/2025

An order dated 15 July 2026 accumulated appeal 3319/2025 into 3304/2025. The chamber also recorded that certain appearing parties in 3304/2025 had not yet been served with the appeal and ordered the corresponding procedural step; it also opened submissions regarding opposition/cross-appeal and a request for documentary evidence in second instance.

What the 15 July 2026 order does — and does not do

It takes four relevant procedural steps: accumulates 3319/2025 into 3304/2025; gives ten days for opposition/cross-appeal regarding LPB's appeal; gives five days on whether there remains an interest in deciding a reconsideration request in 3319/2025; and gives five days regarding LPB's request for documentary evidence.

It does not decide the merits and does not establish that the entire Sun Park history is before the chamber. That is why the proper public question is whether the record is sufficient and traceable for the issues actually under appeal.

Second-instance documentary questions

  1. What is the current status of RPL 2523/2025, and which culpability-section materials are actually in the appeal record?
  2. Which complete parts of Insolvency 36/2012 were transmitted in 3304/2025 and 3319/2025?
  3. Which later or previously unavailable documents have been sought as second-instance evidence, and with what outcome?
  4. What effect followed from the service omission identified by the chamber in 3304/2025, and when was it cured?
  5. Which issues can Section 4 review within each appeal's scope, and which remain outside it?

Reasonable defence preserved

A Provincial Court is not a de novo investigative body. Review is bounded by the appealed rulings, grounds, transmitted record and rules governing later evidence. The correct question is not why the chamber does not investigate the whole history, but whether it has a complete and procedurally usable record for what is actually before it.

What this page does not establish

It does not establish bias, judicial wrongdoing, deliberate delay or concealment. Nor does it turn accumulation, scheduling or procedural cure into a conclusion on the merits.
