MEDIA · REPORTING PROCESS → VERIFICATION → WAIT FOR JUDICIAL MATERIAL → NON-PUBLICATION → SOURCE AUDIT

A developed reporting process stopped after one adverse judicial document arrived. The document deserves the same scrutiny as the story it stopped.

The January 2025 record now reaches back before the 20 January non-publication email: a pre-meeting call request, Patricia's video contact, a timestamped Madrid newsroom meeting, contemporaneous legal review, the request to wait until Monday for judicial material, and then Sentencia 163/2023. This page separates what the sources prove from what remains attribution, inference or an open provenance question.

What the 9 September 2026 source refresh changes

MEETING VERIFIED

15 January, Madrid

A Google Calendar event titled “Javier @El Economista” fixes the in-person meeting at 13:00–14:00 at C. de la Condesa de Venadito 1, Madrid. Patricia's inbox separately preserves an Otter.ai conversation record titled “Javier @El Economista” at 12:00.

VIDEO + IN-PERSON

The two-contact sequence is contemporaneous

On 15 January Patricia proposed a video call. That evening, a contemporaneous communication to Sixto Abogados recorded that Gil had been in Madrid and spoken with Javier and that Patricia had also spoken with him by video.

CAM WAS A CREDITOR

Access is not the same question as transmission

A 2 April 2019 providencia in the calificación lists Construcciones Acosta Matos, S.A. as “Acreedor”. Historical Insolvency Act art. 168 allowed creditors/persons with legitimate interest to personarse and be party in the section. The unresolved issue is therefore the exact route to the newsroom, not a categorical claim that CAM could never have had access.

MADRID ARCHIVE LOCATED

The later querella is context, not the story

The 5 May 2025 archive order says the filed material did not establish that Laura personally sent the judgment to Romera; it also reasoned from CAM's creditor status to legitimate access for purposes of the criminal theory before it. Both points are preserved here.

The reporting chronology before the stopper document

2020 · independent commercial background. Preserved Meeting Point Hotels material describes Club Sei Lanzarote; a sonnenklar.TV offer places Club Sei Lanzarote at Calle Janubio 3, matching the historic Sun Park address. This documents public presentation/distribution in the FTI/Meeting Point ecosystem while leaving contracts, unit authority, bookings and payment flows open.
3 January 2025 · formal questions to Meeting Point. A preservation/confirmation request sought contracts, commercialisation, inventory, bookings, commissions, payments and related records. No January inbound Lars Creutzmann response has been located in the searched mail/file corpus; another channel remains possible.
14 January · Romera asks to speak before the meeting. Romera writes that he has the material and asks to speak the next morning before the meeting. This independently establishes that the reporting process was already active before the physical newsroom meeting.
15 January, approximately 12:00 · Patricia video/contact record. Patricia proposed the video call that morning. Otter.ai preserves a timestamped “Javier @El Economista” conversation record at 12:00.
15 January, 13:00–14:00 · in-person meeting at elEconomista's Madrid offices. The calendar fixes the meeting and newsroom address. A same-day communication to Sixto Abogados records Gil's Madrid conversation with Romera and Patricia's video contact. Participant recollection additionally describes interview questioning, photographs and Miguel's participation/presence; those extra details remain open for independent corroboration and are not presented here as established fact.
16 January · legal review of the press material. Javier Sixto reviewed the proposed note and recommended careful attribution, qualification and external verification. That review shows contemporaneous attention to publication risk; it does not prove every underlying allegation.
16–17 January · Meeting Point / CAM response sequence. Contemporaneous party memorialisations record incompatible accounts about Meeting Point commercialisation and refer to communications with Meeting Point and Laura/CAM. Three preserved Romera OGG filenames map to CAM, Meeting Point and non-publication. Until those audios are exported, authenticated and transcribed, the exact call order and the assertion that Laura's call was unsolicited remain attributed, not established.
17 January · wait until Monday. Romera directly denies censorship and explains that facts need to be properly tied down. In the same direct email he confirms: “Solo me han pedido esperar al lunes para pasarnos unos autos judiciales.” The grammar does not identify who “me han” refers to, but it independently confirms the sequence wait → Monday → judicial material.
20 January · the judicial document arrives and publication stops. Romera reports receipt of the judicial file and says publication cannot proceed on that basis. The attachment filename says AUTO CONCURSO CULPOSO.pdf; the enclosed instrument is Sentencia 163/2023, dated 28 September 2023.

The stopper document: adverse, but narrower than the proposed story

Judgment, not “Auto”

The file label was not the instrument's legal nature. The document is Sentencia 163/2023.

LPB, not the whole hotel

The operative part classifies the insolvency of Luchy Playa Blanca, S.L. as culpable. It does not turn every Sun Park owner or property into the debtor.

Already appealed

The preserved record contains appeals filed in October/November 2023 and appellate personation before January 2025. The judgment itself links the disqualification period to finality.

It did not decide the entire pitch

It does not decide the full Meeting Point commercialisation chain, mixed/extraconcursal ownership, RIC/RICPE architecture or public/European-funding questions put to the newsroom.

This is not a minimisation of the calificación. It is a materially adverse first-instance judgment. Precision about debtor, object, appeals and unresolved subjects is required precisely because the document had real external consequences.

Why was Acosta Matos in the calificación?

The best current answer is documentary, not speculative. The 2 April 2019 providencia in the classification section lists Construcciones Acosta Matos, S.A. as a creditor/intervenor, represented by procurador Gerardo Pérez Almeida, and records that the relevant reports were available to parties personated in the section.

The historical Ley 22/2003, art. 168 provided that any creditor or person proving a legitimate interest could personarse and be party in the classification section. That supplies a procedural explanation for CAM's corporate presence/access.

Entity distinction: this is not the same as saying Laura Patricia Acosta Matos personally was a claimant or affected person. Sentencia 163/2023 names CAM as a creditor. The public provenance question is therefore: who physically transmitted the unredacted judgment to the newsroom, through what channel, and with what description of its finality, debtor and scope?

The March 2025 Madrid querella: a source-control check

The later Madrid querella was filed as a criminal theory concerning disclosure/transmission. It was archived on 5 May 2025. The archive order matters here for two reasons: it says the filed documentation did not establish that Laura personally sent the judgment to Romera, and it reasons that CAM's creditor position supplied legitimate access for purposes of the theory before the court.

That outcome prevents us from publishing “Laura leaked the judgment unlawfully” as an established proposition. It also does not identify the physical transmitter. The querella therefore sits behind this page as contemporaneous procedural/evidential context; the story remains the January reporting process and the document that stopped it.

Concrete collateral effect — and why timing matters without proving motive

Whatever the ultimate appellate merits of Sentencia 163/2023, one practical consequence is directly documentable: the proposed elEconomista investigation had progressed through verification and a Madrid meeting; judicial material was awaited; the judgment arrived; publication then stopped. That is a concrete external/collateral effect of the judgment's use and description. It is not by itself proof of a crime, conspiracy, tort or improper editorial motive.

FITUR 2025 took place in Madrid from 22 to 26 January, with the first three days reserved for professionals and an explicit business-generation focus. The newsroom sequence culminated on 20 January, immediately before FITUR week. This timing is relevant commercial context. Current source control does not yet prove Acosta Matos attendance, a particular JV/investment/government transaction, or that FITUR caused any intervention with the newspaper. Those remain finite evidential questions rather than published conclusions.

Editorial satire: the due-diligence minefield

The accompanying concept is intentionally broader than this dispute: two polished professionals cross a field of obvious warning signs, one refusing to see and the other refusing to hear, while the checklist says “due diligence completed”. The point is about performative scrutiny: a warning that stops a process should itself be scrutinised. The named-actor caricature image is not yet published.

Finite questions that can close the remaining gaps

  1. Who physically transmitted Sentencia 163/2023 to Romera, from what account/device, with what text and metadata?
  2. Can the three Romera OGG files be exported, hashed, speaker/date authenticated and transcribed?
  3. Do the native records prove the precise sequence Meeting Point call → Laura inbound call and whether that call was unsolicited?
  4. Is there a newsroom note, transcript, photograph or metadata corroborating the reported photo-taking and Miguel's participation at the 15 January meeting?
  5. What did the transmitter say, if anything, about finality, pending appeals, the LPB-only debtor perimeter and the scope of the judgment?
  6. What did elEconomista verify about the document before treating it as dispositive of the proposed story?
  7. What primary evidence identifies any CAM/Acosta Matos FITUR 2025 attendance, meetings or transactions relevant to motive/timing?
  8. What is the certified current appellate/finality status of Sentencia 163/2023?

Right of reply and correction

This page does not allege that Javier Romera or elEconomista acted in bad faith or colluded with an adverse party. Romera's stated verification caution was legitimate. The question is whether equivalent scrutiny was applied to the document that caused the investigation to stop.

We invite Javier Romera, elEconomista / Editorial Ecoprensa, Laura Patricia Acosta Matos, Construcciones Acosta Matos, the relevant Meeting Point entities and any person directly involved in the January sequence to provide primary material correcting or completing this reconstruction. Documented corrections should receive equivalent prominence.
