Aweswell/Sun Park identified Borja Rodríguez-Batllori Laffitte to the Grant Thornton Forensic team involved in the 2020 process as lawyer and insolvency administrator, together with José Acosta Matos/CAM and other parties, for GT's internal conflict procedure.

The internal closure does not yet resolve an earlier and more precise issue: how the 2020 conflict/confidentiality memory, the acknowledged Canary commercial relationship, the preserved public professional presentation and the categorical statement relayed by GTIL in December 2024 fit together.

Statement-quality issue
“Does not work for the Firm in any capacity” is broader than “not employee/not partner”.
On 21 December 2024, GTIL stated, on behalf of its legal team, that Grant Thornton Spain had confirmed Francisco de Borja Rodríguez-Batllori Laffitte was neither partner nor employee and “does not work for the Firm in any capacity”. The same message said the Firm was taking action to have allegedly misleading LinkedIn information amended.
On 8 January 2025, GT Spain's own Internal Information System added a material fact: Rodríguez-Batllori provided services on a commercial basis to a Grant Thornton partner company in Spain located in the Canary Islands.
Limited conclusion. This record does not show that the December statement was deliberately false. But unless “the Firm” and “any capacity” are explained at legal-entity level, the categorical wording is potentially materially incomplete and capable of misleading a reader about the later-acknowledged professional/commercial relationship. A high transparency standard calls for an express correction or reconciliation.
2020 prevents this from being treated as though Grant Thornton had no prior institutional memory
Grant Thornton Forensic confirmed no conflict or independence issue preventing the proposed engagement and requested key information to define scope.
A confidentiality agreement was executed with Grant Thornton Advisory, S.L.P., a specific Spanish professional entity.
Grant Thornton Advisory, S.L.P. issued a formal proposal for an independent forensic investigation into Sun Park. Its background included Insolvency 36/2012 and allegations concerning the insolvency administrator. The proposal does not itself prove that the engagement commenced.
Question requiring an answer: was this 2020 conflict/confidentiality record available or consulted when Rodríguez-Batllori's later professional/commercial relationship within the Cuyás / Grant Thornton Canarias perimeter began or continued?

PUBLIC GRANT THORNTON PROFESSIONAL RECORD
Grant Thornton professional identification
LinkedIn: “Abogado — Grant Thornton Canarias” · Sep 2023–Present · Cuyás Abogados / Grant Thornton Canarias banner. A contemporaneous 21 December 2024 capture of Rodríguez-Batllori's own LinkedIn profile publicly identified him through the Grant Thornton Canarias name. Separate GT/Cuyás materials and professional communications also used “Senior Advisor de Legal” and es.gt.com infrastructure. This establishes public professional identification; it does not by itself identify the employing/contracting legal entity or establish GT Spain employment, supervision or liability.
Reconciliation test. These three propositions are not necessarily incompatible. They cannot, however, be understood together without identifying the relevant legal entity, dates, professional capacity and functional perimeter.

What this proves — and what it does not. The capture establishes that the profile publicly represented Rodríguez-Batllori as a lawyer at Grant Thornton Canarias on 21 December 2024. It does not by itself determine the underlying employing/contracting legal entity, establish employment by Grant Thornton Spain, or determine supervision, insurance or liability.
LinkedIn correction trail
The 21 Dec 2024 profile is preserved. GTIL's announced correction remains an open institutional record.
A contemporaneous capture has now been identified in the evidential archive. Current searches have not located an accessible individual profile for Rodríguez-Batllori. That does not distinguish between deletion, deactivation, renaming, general restriction or a user-specific block.
GTIL/GT Spain is asked to confirm: which element of the preserved 21 December 2024 profile was considered misleading — the Grant Thornton Canarias organisation field, the Cuyás Abogados / Grant Thornton Canarias banner, the “Abogado — Grant Thornton Canarias” experience entry, or another item; what amendment was requested; who requested it; when; whether the profile was corrected or deleted/deactivated; and whether they are aware of any restriction specific to Gil Marer. Screenshots, instructions and correspondence should be preserved. Any individual block would not itself establish professional responsibility.
Potential professional responsibility
Shared responsibility is framed as a testable legal hypothesis, not a conclusion.
Spanish Law 2/2007 provides for joint and several responsibility of a professional company and the professionals who acted in respect of certain debts deriving from professional acts, and extends the regime to certain collective professional activity under a common denomination. Applying that regime here first requires proof of the professional act, capacity, entity, authority/supervision, damage and causation.
Control rule: branding, an email domain or office address does not establish liability. It does justify requiring the reconstruction: document → professional act → capacity → entity → authority/supervision → duty → damage → causation → applicable rule.
